January 14, 2009 – New Marine Pollutant Marking, New Small Quantity Exceptions, New Incident Reporting Requirements

Dear Valued Customers:

The Department of Transportation has just issued its Final Rule under HM-215J and HM-224D affecting international harmonization. Included in this final rule are amendments regarding the transportation of batteries and battery-powered devices:
  1. New incident reporting requirements
  2. Clarification of requirements on whether a battery is non-spillable
  3. New requirements for the transport of dry batteries
  4. New package marking requirements
  5. Clarification of requirement on transporting batteries in order to prevent short-circuiting, dangerous evolution of heat, damage to terminals, or for air, unintentional activation.
The final rule also includes also adopts other changes aimed at international harmonization:
  1. New Marine Pollutant Marking
  2. New Small Quantity Exceptions
  3. Changes to the 172.101 Table
  4. Amendments to the Organic Peroxide Tables
  5. New Fuel Cell Requirements, including new proper shipping names
Voluntary compliance is authorized immediately, with a delayed compliance date of Jan. 1, 2010. You can view the Final Rule in its entirety via the following link - E8-31383.pdf.
