Federal law requires all persons engaged any activity involving hazardous materials, substances, chemicals and waste to complete an updated training program on the Federal regulations requiring compliance.

THE “Critical Interface” PROBLEM

Compliance may become clearer when the “INTERFACE” is laid out as per the chart. For example, when one of the 50,000 plus Hazardous Materials is in transportation, it is subject to the DOT Regulations in 49 CFR. When used in-plant, it now is subject to the OSHA Regulations in 29 CFR. When it no longer has a value and will be discarded, it is subject to the joint DOT/EPA/OSHA Regulations in 49/ 40/29 CFRs.

If, at any time in either of these three areas, it is released or discharged from its container into the environment in an “RQ” quantity, and is not recovered, it is now a Hazardous Substance and is subject to the reporting responsibilities of the Hazardous Materials Transportation Act, the Comprehensive Environmental Response, Compensation and Liability Act, and SARA/Title III. Understanding these interfaces is one of the objectives of the seminar.

TRANSPORTATION – HAZMAT EMPLOYEES
U.S. & State Departments of Transportation (Section 172.700, 49 CFR)

State and Federal DOT regulations require each shipper, generator, carrier and transporter to instruct and test all company officials, employees or agents on the applicable hazardous materials regulations pertaining to their job functions and contact with hazardous materials and substances on a triennial basis.

ENVIRONMENT –ᅠ HAZARDOUS WASTE GENERATORS
U.S. & State Environmental Protection Agencies (Part 262, 262.14, 262.25, 262.16, 262.17 and 265.16, 40 CFR) 

State and Federal EPA regulations require each generator and owner/operator of a TSD Facility to ensure that all employees engaged in any activity involving hazardous waste successfully complete a training program on the applicable DOT, OSHA and EPA regulations. This requirement must be carried out on an annual basis

HAZMAT EMPLOYERS ARE REQUIRED TO SUCCESSFULLY TRAIN ALL HAZMAT EMPLOYEES ON “GENERAL AWARENESS AND FAMILIARIZATION, FUNCTION- SPECIFIC, SAFETY AND SECURITY AWARENESS” IN SECTION 172.700 OF 49 CFR UNDER DOT. TRAINING IS ALSO REQUIRED UNDER EPA’S “GENERATOR’S HAZARDOUS WASTE MANAGEMENT STANDARD” IN SECTIONS 262.14, 262.15, 262.16, 262.17 and 265.16 OF 40 CFR AND OSHA’S “FIRST RESPONDER AWARENESS LEVEL” IN SECTION 1910.120(q) OF 29 CFR.

After completing the Hazardous Materials & Waste seminar, participants registering for the “TRAIN-THE-TRAINER®” will be exposed to the most effective, successful and inexpensive means and the specific training manuals and aids to meet the required training and testing requirements mandated by State and Federal laws.

Who Should Attend?

Anyone who classifies, packages, marks, or labels dangerous goods shipments or completes and/or signs dangerous goods shipping papers for shipment (domestically or internationally) in the air mode under the IATA and DOT regulations, including freight forwarders. Because of the complex nature of the hazardous materials and dangerous goods transportation regulations, this seminar has been developed for individuals who already have experience with DOT and/or IATA regulations – those who have been trained, tested and certified in the past 2 years. Attendees should have a basic knowledge of classification; documentation (shipping papers); packaging; labeling and marking.

It is almost impossible to ship by air using solely one set of regulations. Air shippers need to utilize both DOT and IATA regulations. This course is designed to help attendees get comfortable with using the IATA regulations and understand their responsibilities within the regulations. We can work with this too, by offering you an in-house for the majority of your employees, and allowing the rest to attend one of our many scheduled seminars throughout the United States. For example, say you have 50 employees requiring training. Of those, only 40 can attend your In-house seminar. You could schedule training for all 50 (and pay the low per-person In-house fee), with 40 to attend at your location and 10 to attend any of our seminars convenient to them. Or, what if some of the 40 can’t attend the In-house due to illness or an emergency at your location?  These people would also be able to receive their training at another of our seminars.  Using this combination of In-house training and our scheduled seminars, you can train all your people at the lowest cost and most convenience.  Simply call our office to discuss your training needs in advance and we will gladly discuss this training option with you.

Why do I need to be trained?

 

Periodic Training is mandatory under the DOT, EPA and OSHA Regulations.  Additionally, workers must be trained on any regulatory changes affecting their job functions as they become effective.  DOT requires training and testing every three years (49 CFR 172.700), EPA requires annual training (40 CFR Part 262 and 265.16) and OSHA requires annual training (29 CFR 1910.38(a), 1910/120(q) and 1910.1200).

Will I receive certification of training?

All attendees will receive certificates of completion and training documentation for each of the areas covered – DOT, EPA and OSHA, attesting that they have completed the mandatory annual and triennial review of the hazardous materials, substances and waste management and hazard communication requirements.  These documents are requested during state and federal inspections.

 

Are seminar fees tax deductible?

An income tax deduction is allowed for expenses of education, including registration fees, travel, meals, lodging, etc., undertaken to maintain or improve professional skills.  (See Treasury Reg. 1.162-5 Couglin vs. Commissioner, 203F. 2nd 307.)

 

What are your payment terms?

Registration fees for seminars are payable in advance.  Multi-person discounts are applicable only for registrations made at the same time for the same city and date.  We accept Visa, MasterCard, American Express or check.

 

Are substitutions or cancellations allowed?

Substitutions may be made at the time of the seminar.  All cancellations must be received at least seven (7) business days in advance of the seminar’s scheduled date.  Fees are not refundable after this time frame, but can be held as a credit for a future date.
